Hong Kong Department of Justice issues consultation paper on the proposed application of the CISG

Hong Kong's status under the CISG is not clear-cut and courts from different jurisdictions have reached different conclusions on whether Hong Kong can be considered a "Contracting State" territory under Art. 1(1)(a) CISG, see the relevant Article-by-Article-section in this regard and the broader information on Hong Kong in the CISG-by-jurisdiction-section.

On 2 March 2020, the Hong Kong Department of Justice commenced a public consultation on the proposed application of CISG to the Hong Kong Special Administrative Region by issuing a comprehensive Consultation Paper, accompanied by a Press Release.

 
 

The consultation paper addresses pros and cons of applying the CISG to the Hong Kong SAR and poses specific questions to the legal and business community.
