Impact of Art. 19 on the interpretation of non-CISG provisions

Beyond its actual sphere of application, Art. 19 CISG has occasionally been used as guidance by courts when interpreting provisions of domestic or international law. Some examples are listed below.

Austrian law:

Czech Republic
Insolvent wholesaler case
Oberster Gerichtshof (Austrian Supreme Court)
Austria, 13 September 2001 – 6 Ob 73/01f, CISG-online 644
Brief reference made to Art. 19(2) CISG in considering the need to discuss the correct approach to a "battle of the forms" scenario under Austrian domestic law (the Supreme Court eventually found the question to be irrelevant in the present case)

Spanish law:

Czech Republic
Promociones Don Sento S.L. v. Promociones Calle Blasco Ibáñez S.L.
Audiencia Provincial de Alicante (Court of Appeal Alicante)
Spain, 03 April 2003 – 176/2003, CISG-online 3970
