Till Maier-Lohmann's „Property in Goods and the CISG“ published open access

The CISG is, by default, limited in its scope and therefore not comparable to a comprehensive code. One of its limitations pertains to the treatment of property in the goods sold, as mentioned in Art. 4(b) CISG.

In his recently published monograph, “Property in Goods and the CISG”, Till Rau (formerly Maier-Lohmann), a member of the CISG-online project team, provides a comprehensive analysis of the various aspects that emerge from this limitation of the CISG’s substantive scope of application. He addresses, for instance, the uniform interpretation of the obligation to transfer property in the goods (Arts. 30 and 41 CISG), the recognition of an autonomous notion of property within the CISG, the interplay of such an autonomous notion with the characterization of sales contracts under the CISG, and the interaction between property and the CISG’s claim to the purchase price (Art. 62 CISG).
