Editorial remark

In the present arbitral award, the sole arbitrator found that a contractual choice-of-law clause calling for the contract to be "governed and construed in accordance with the international commercial rules" could not be construed as a contractual choice of the CISG. However, the arbitral tribunal applied the CISG as the rules of law which it determined to be appropriate in accordance with Art. 21(1) of the ICC Arbitration Rules (2017).
