This decision deals with various claims arising out of a contractual relationship between Demka GmbH (the Claimant), a German manufacturer of cheese sticks (a snack), and Enfa Groothandel B.V. (Respondent), a Dutch food and beverage wholesaler.
Most of the decision addresses Demka's claim of a trademark infringement by Enfa, which the Court eventually grants.
In addition, the decision (in paras. 60–71) grants Demka's claim for the payment of an outstanding contract price and interest under the CISG.
