In the dispute concerning clothing the court had to decide whether a contract had been concluded or not. Denmark has excluded the use of part II of the CISG(formation of contract), but as the rules of international private law (Hague Convention 1986) pointed to French law, CISG part II on formation of contract applied to the dispute.
