Hiking guidebooks case
Landgericht Köln (District Court Cologne)
Germany, 29 May 2012 – 88 O 57/11, CISG-online 2476
Editorial remark
by Ulrich G. Schroeter
In this decision, the court applied the CISG to a sales contract between a German party and a party from Hong Kong in accordance with Article 1(1)(a) CISG. In its reasoning, it merely stated that 'both Germany and China are Contracting Parties to the CISG', without elaborating whether the Hong Kong SAR has a special status in this respect.
