In the present decision, the French Supreme Court addressed the much-disputed question whether the Hong Kong SAR (Special Administrative Region of the People's Republic of China) has been a "Contracting State" territory in the sense of Art. 1(1) CISGs since the "handover" on 1 July 1997. It decided the question in the negative, holding that the People's Republic of China had made a notification "equivalent" to a declaration of non-application envisaged by Art. 93 CISG ("une formalité équivalente à celle prévue par son article 93"), so that post-1997 Hong Kong cannot be considered "Contracting State" territory under the CISG.
