The present decision only addresses the jurisdiction of the German courts under Art. 23 (forum selection agreement) and Art. 5 (jurisdiction of the court at the place of performance) of the Council Regulation (EC) No 44/2001 of 22 December 2000 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters (the EU’s “Brussels I” Regulation). In this context, the Court applies the CISG. As the Court eventually concludes that the German courts lack the necessary jurisdiction, no discussion of the merits of the dispute takes place.
