The present decision deals mainly with the question whether the German seller and Austrian buyer had agreed on a forum selection clause contained in the seller's standard terms in accordance with Art. 23(1) of the Brussels I Regulation. In this context, the Court of Appeal also outlines and applies the requirements of an incorporation of standard terms under the CISG (in paras. 17–19 of the decision).
